Ina22-pageorder,U.S.DistrictJudgeSharonGleasonstatedthatDOIneededtoobtainacourtordertocancelthesevenleasesthathadbeenawardedtotheAlaskaIndustrialDevelopmentandExportAuthority(AIDEA)beforetheBidenadministrationtookofficein2021.
“ThereisnoreasonDOIcouldnotfileanactionseekingdeclaratoryreliefinsuchcircumstances,”Gleasonstated.“Accordingly,FederalDefendants’cancellationofAIDEA’sleaseswasnotinaccordancewithlawbecauseitfailedtoseekacourtorder.”
